By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.
1. Eligibility and Account Registration
You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained parental or guardian consent. By registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
2. Description of the Service
Ailume Music is an AI-powered music creation platform that allows users to generate original songs, lyrics, instrumentals, vocal tracks, and covers from text prompts. The Service includes a Creation Center, Library, Hooks community gallery, Clip editor, and multi-format export tools (MP3, WAV, ZIP, cover art). Features available to you depend on your subscription plan.
3. Subscription Plans, Credits, and Billing
Ailume offers a free tier and paid subscription plans. Paid plans are billed on a monthly or annual basis through PayPal. All prices are displayed in United States Dollars (USD).
Credits are the currency used within the Service to generate songs, remixes, covers, and other production assets. Credits are allocated per billing cycle and do not roll over to the next period unless otherwise stated. Failed generations are refunded to your credit balance at our discretion.
By subscribing to a paid plan, you authorize us to charge the applicable fees to your PayPal account on a recurring basis until you cancel. Annual plans are billed in full at the time of purchase. You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of the current billing period.
4. Free Trial and Free Credits
New users may receive free credits upon registration to explore the Service without a credit card. Free credits are subject to availability and may be modified or discontinued at any time. Free-tier outputs are subject to the content restrictions and licensing terms described below.
5. Intellectual Property and Content Ownership
5.1 Your Prompts and Inputs
You retain ownership of any original text, lyrics, or other inputs you provide to the Service. By submitting inputs, you grant Ailume a limited, non-exclusive, worldwide, royalty-free license to process your inputs solely to provide the Service.
5.2 AI-Generated Outputs
Subject to your compliance with these Terms and any applicable plan restrictions, Ailume grants you a license to use the AI-generated audio, lyrics, and cover art produced through the Service as follows:
- Free plan: Personal, non-commercial use only. Attribution to Ailume Music may be required.
- Paid plans: Full commercial usage rights for every exported track, including use on YouTube, Spotify, TikTok, Instagram, in podcasts, wedding videos, advertising, gaming projects, and other monetized content. No revenue sharing or attribution requirements apply.
You represent that you will not use AI-generated outputs in any manner that violates applicable law, infringes third-party rights, or breaches these Terms.
5.3 Ailume Intellectual Property
The Ailume platform, including its software, design, AI models, brand, logos, and all underlying technology, is owned exclusively by Ailume Music and its licensors. You may not copy, reverse-engineer, decompile, or create derivative works of the platform.
6. Prohibited Uses
You agree not to use the Service to:
- Generate content that is unlawful, defamatory, harassing, abusive, obscene, or otherwise objectionable;
- Infringe the intellectual property rights of any third party, including using the Service to reproduce, distribute, or create derivative works of copyrighted music without authorization;
- Upload, transmit, or distribute malware, viruses, or any harmful code;
- Attempt to gain unauthorized access to any part of the Service, its servers, or connected databases;
- Use automated scripts, bots, or crawlers to access the Service in a manner that exceeds reasonable use or disrupts server operations;
- Misrepresent AI-generated outputs as human-created content in contexts where such deception is harmful or illegal;
- Resell, sublicense, or otherwise transfer access to the Service to third parties without our express written consent.
7. Community Content and the Hooks Gallery
The Ailume Hooks gallery is a public community space where users can publish and share AI-generated songs. By publishing content to the Hooks gallery, you grant Ailume and other users a non-exclusive, royalty-free license to view and listen to your published tracks within the platform. You retain ownership of your content and may remove it at any time.
Ailume reserves the right, but has no obligation, to review, remove, or restrict access to any community content that violates these Terms or our Community Guidelines.
8. Third-Party Services
The Service integrates third-party services, including PayPal for payment processing. Your use of third-party services is governed by their respective terms of service and privacy policies. Ailume is not responsible for the practices of any third-party service provider.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AILUME DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AILUME AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL AILUME'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO AILUME IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100).
11. Indemnification
You agree to indemnify and hold harmless Ailume and its affiliates, officers, directors, employees, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your content, or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including your breach of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will do so, including ownership provisions, warranty disclaimers, and limitations of liability.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last Updated" date above. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with applicable law. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration.
